FINES CAN NOT BE USED TO PAY DOWN DEBT BALANCES
- A bankruptcy court judge in Florida recently ruled that a loan servicer could not set off a fine for violating a state consumer protection act by reducing the amount owed by the borrowers. As well, the plaintiffs did not “expressly and clearly” revoke consent for the servicer to contact the borrowers on their cell phones.
BORROWERS ADDING MORE DEBT, MAKING FEWER PAYMENTS
- Higher interest rates will lead to borrowers paying $1.3 billion in additional debt, according to data released yesterday by CardHub. The amount of debt on cards increased in the third quarter of 2015 and the delinquency rate on card payments also increased, according to CardHub.
