COURT GRANTS SUMMARY JUDGMENT IN FAVOR OF COLLECTION AGENCY IN TCPA CASE
- A U.S. District Court judge in Florida has potentially become the first in the nation to establish limits to the Federal Communications Commission’s definition of what constitutes an automated telephone dialing system (ATDS). The case, Strauss v. CBE Group, Inc., involved 26 calls that were made to the plaintiff, but all of the calls were meant for someone else. The plaintiff never informed the agency that it was calling a wrong number and then subsequently sued the agency for violating the Telephone Consumer Protection Act. The judge granted a summary judgment in favor of the collection agency saying that the dialer used by the company was not an ATDS.
N.J. LEGISLATURE CONSIDERS BILL TO AMEND FILING FEES FOR LAWSUITS
- A bill has been introduced in the New Jersey legislature that would amend the filing fees, penalties, assessments, and penalties for filing lawsuits in The Garden State. A copy of the proposed legislation can be viewed here.
APPS HELPING INDIVIDUALS DEFEND THEMSELVES IN COURT
- A number of new programs and apps have been released to help individuals prepare and fight in court. The apps make it easier for individuals to receive representation or help prepare for lawsuits that have been filed against them. In most states, individuals do not have a right to legal representation in civil cases, which include most debt collection lawsuits. The apps can help individuals understand when a plaintiff has made a mistake with filing deadlines, for example.
