VIRGINIA SUED OVER LICENSE SUSPENSION POLICY
- A class-action lawsuit has been filed against the state of Virginia over its policy of suspending the driver’s licenses of those who have unpaid court fines and costs. Approximately 11% of the population in Virginia – about 900,000 residents – have their licenses suspended at any point in time, according to the suit. The state automatically suspends the licenses of individuals who have court fines or costs more than 30 days overdue. But the suit argues that the policy fails to determine whether those individuals have the ability to repay the fines before imposing the suspension and violates the individuals’ right to due process.
ALABAMA CITY SUED FOR ALLEGEDLY RUNNING DEBTOR’S PRISON
- The city of Anniston, Alabama, is being sued for allegedly operating a debtor’s prison by incarcerating individuals who have unpaid fines and court costs. The city had contacted with a private company, Judicial Correction Services, to manage the city’s probation operation, and that company did not take into account the individuals’ ability to repay the costs before having them jailed. The company stopped operating in Alabama last November after a number of lawsuits were filed.
LAWYER ORDERED TO REPAY $1.8 MILLION AFTER INFLATING FORECLOSURE COSTS
- A Colorado lawyer has been ordered to repay $1.8 million after he was found guilty of charging misleading fees and charges for title insurance policies that, in some cases, were never even issued. Homeowners seeking to prevent their homes from foreclosure were told they needed to pay the additional fees to remain in their homes. The lawyer shut down his law firm in 2013.
MORE THAN 100 DEMOCRATS SEND LETTERS TO CFPB PRAISING ARBITRATION RULE
- As if there wasn’t already a strong bond between Democrats and the Consumer Financial Protection Bureau, more than 100 members of Congress have sent letters to the agency praising its proposed rule to ban mandatory arbitration clauses in consumer lending contracts. There wasn’t much substance in the letters, but it was full of ringing endorsements.
MORE SUBPRIME CONSUMERS GETTING CREDIT CARDS
- More individuals with less-than-perfect credit are getting credit cards, according to a report released by the American Bankers Association. The number of new credit card accounts reached 83.5 million in the first quarter of 2016, up 26% from the same period a year earlier. The number of new subprime accounts increased significantly, but still remains well below the peak seen just before the Great Recession.
