GAO REPORT REVEALS HOW SBREFA PANELISTS FEEL ABOUT THEIR PARTICIPATION
- If past participation is any indicator, than those individuals who will be participating in the Consumer Financial Protection Bureau’s SBREFA hearings on the proposed debt collection rule will not be happy with what the CFPB ends up doing. The General Accountability Office released a report last week that analyzed four sets of SBREFA hearings held by the CFPB on different rule proposals. The GAO interviews 57 of the 69 participants, and of those 57, only seven were happy with the final rules released by the agency. About 70% of those interviewed by the GAO did say they felt the CFPB took their comments into consideration when issuing the final rule.
APPEALS COURT RULES LAW FIRM THAT DID NOT MENTION IT WAS A DEBT COLLECTOR DID NOT VIOLATE FDCPA
- The Ninth Circuit Court of Appeals has ruled that a law firm that included its name in a voicemail message, but did not expressly state that it was a debt collector did not violate the Fair Debt Collection Practices Act. The ruling overturns a District Court ruling. In this particular case, the Appeals Court ruled, that because the plaintiff and the defendant already had exchanged a number of email messages and voicemails, not mentioning that it was a debt collector did not violate the FDCPA.
