FDCPA SUIT NUMBERS DROPPING, FCRA & TCPA SUIT TOTALS RISING
- The number of lawsuits alleging violations of the Fair Debt Collection Practices Act continue to decline while the number of suits alleging violations of the Telephone Consumer Protection Act and the Fair Credit Reporting Act continue to rise, according to data released yesterday by WebRecon. The number of complaints filed against collectors with the Consumer Financial Protection Bureau are also dropping.
APPEALS COURT HEARS ARGUMENTS IN ACA’S TCPA CASE AGAINST FCC
- The Court of Appeals for the District of Columbia heard oral arguments yesterday in the lawsuit filed by ACA International against the Federal Communications Commission, 15 months after the suit was initially filed. The lawsuit was a reaction to changes made to the Telephone Consumer Protection Act by the FCC. While originally slated for 20 minutes of oral argument for each side, the judges asked questions for three hours during the hearing yesterday. There is no timeline for when the appeals court will issue its ruling.
LARGEST EVER TCPA SETTLEMENT DEAL REACHED; PLAINTIFFS WILL RECEIVE UP TO $76 MILLION
- In what is being described as the largest settlement ever related to a Telephone Consumer Protection Act lawsuit, a handful of companies have agreed to set aside as much as $76 million after allegedly making 900,000 robocalls to individuals offering free cruises in return for taking a political survey. Litigation had been ongoing for more than four years.
COLLECTION ATTORNEYS MUST REGISTER TO COLLECT DEBTS IN NYC
- The New York City Department of Consumer Affairs has issued a formal notice, indicating that attorneys and law firms that collect debts from residents of New York City must register as collection agencies with the city. Attorneys and law firms have until Nov. 30 to register.
