APPEALS COURT RULING FURTHERS CIRCUIT SPLIT ON FDCPA VIOLATION
- A third Appeals Court has ruled that collection letters offering to settle debts that are past the statute of limitations but which do not disclose that fact are violations of the Fair Debt Collection Practices Act. Two other Appeals courts have ruled that a settlement offer — which does not include the threat of litigation — on a time-barred debt is not an FDCPA violation. This most recent ruling came from the Fifth Circuit Court of Appeals, which includes Texas, Mississippi, and Louisiana. The Appeals Court overturned a District Court ruling that dismissed a debtor’s claim after the individual received a collection letter on a time-barred debt but did not mention the statute of limitations had expired.
DEFENSE DEPT. CONSIDERING SENDING MISTAKEN VETERAN BONUSES TO COLLECTIONS
- The Department of Defense is considering sending accounts to collection to try and recover re-enlistment bonuses and incentives that were mistakenly given to veterans who fought in the wars in Iraq and Afghanistan. In California alone, there are as many as 10,000 members of the California National Guard who have been told to return thousands of dollars. Members of Congress have started standing up and calling for some form of legislation solution to this problem.
NJ LEGISLATURE WORKS ON MEASURES TO EDUCATE STUDENTS ABOUT DEBT RESPONSIBILITIES
- The state legislature in New Jersey is continuing to try and work toward a legislative solution to help students fully understand the responsibilities and obligations that go along with taking out student loans. A government-backed student loan program in New Jersey was put under the spotlight this summer, when a published article revealed it had refused to forgive the debt of a student who died, and was forcing the student’s mother to repay her son’s student loan.
FLU SHOT REMINDERS ARE NOT A TCPA VIOLATION, COURT RULES
- A federal court in California has ruled that sending automated flu shot reminders to individuals is not a violation of the Telephone Consumer Protection Act.
