SERVICER REACHES $2.4M SETTLEMENT AFTER BEING ACCUSED OF VIOLATING STATE DEBT COLLECTION REGS
- A student loan servicer, Xerox Education Services, has reached a $2.4 million settlement with the state of Massachusetts after it was accused of harassing borrowers and charging excessive fees. The servicer violated the state’s debt collection regulations by allegedly calling individuals more than twice per week and failed to investigate credit reporting disputes, according to the state attorney general’s office.
COLLECTION AGENCY, DEBT BUYER EXPANDS IN SOUTH DAKOTA
- An employee-owned collection agency and debt buyer, NCB Management Services, has expanded its Sioux Falls, S.D., call center to 200 employees, from 30 when it opened seven years ago, according to a published report. The senior managers of the agency touted the great community in Sioux Falls and said it was a great place to open up a call center.
501(r) COMPLIANCE OBLIGATIONS “UNDERESTIMATED,” ACCORDING TO LAW FIRM
- A fairly comprehensive overview of the regulations included in 501(r), which dictates the compliance obligations for non-profit hospitals on the governance of financial assistance, billing, and collection practices. The “significance” of the obligations has been “underestimated,” according to a pair of lawyers from Manatt Phelps & Phillips, who lay out why hospitals must “ensure that their contracts with billing and collection vendors include essential terms prescribed by the 501(r) regulations and provide the hospitals with the rights and resources necessary to comply with Section 501(r).”
