COURT TOSSES OUT TCPA CASE AGAINST ROBOCALL BLOCKING SERVICE
- The company that operates the Nomorobo service that aims to block robocalls from being placed to individuals can not sue a collection agency for violating the Telephone Consumer Protection Act, according to a District Court in Illinois. The plaintiffs in the case, Telephone Science Corporation v. Asset Recovery Solutions, LLC, have filed three amended complaints to try and keep the suit alive, but have been turned down every time because the company failed to satisfy the “zone-of-interests” test of the TCPA. The service has logged more than 12,000 calls to one of its honeypot numbers from the defendant, but that still was not enough to keep the case from moving forward.
BANKRUPTCY FILINGS KEEP FALLING
- Despite an increase in the number of business filings, the total number of bankruptcy filings in 2016 fell for the seventh consecutive year and are at their lowest point since 2006, according to data released yesterday by the American Bankruptcy Institute.
IS GEORGIA GIVING WESTERN NEW YORK A RUN FOR ITS MONEY?
- The Atlanta Journal-Constitution asks the question: Is Georgia a haven for abusive debt collectors? It tries to answer the question by listing a number of cases, enforcement actions, and other legal proceedings against debt collection firms in the Peach State. The paper even went as far as to ask the Federal Trade Commission if Georgia was a haven for illegal debt collectors. The FTC said there was no evidence to support that notion.
