FCC PROPOSES RULE TO CRACK DOWN ON ROBOCALLS AND CALLER-ID SPOOFING
- The Federal Communications Commission late last week issued a Notice of Proposed Rulemaking (NPRM) that would try to protect consumers from receiving calls from scammers and robocalls. The proposal would allow carriers to block calls from being sent to individuals’ phones because, according to the FCC, “that the specter of enforcement action under the TCPA and Truth in Caller ID Act does not deter the worst robocallers, often because such callers operate from outside the United States.” The downside to this proposal is that it keeps legitimate calls from being allowed to make it to the individual because it is being blocked by the carrier.
COLLECTION AGENCY FINED $350K BY FTC FOR ALLEGEDLY MAKING FALES THREATS
- American Municipal Services Corp., a collection agency that collects on behalf of more than 500 municipalities across the country, has reached a settlement with the Federal Trade Commission and agreed to stop engaging in allegedly illegal tactics. The agency was using collection letters that had “Warrant Enforcement Division” or “Municipal Enforcement Division” at the top of the letter, which made individuals believe the letters were coming directly from a government agency.
TOLLS NOT DEBTS FOR PURPOSES OF COMPLYING WITH FDCPA: JUDGE
- A toll to drive on a highway, like the New Jersey Turnpike, for example, is not a “debt” as defined by the Fair Debt Collection Practices Act, and the process of sending a collection letter to collect on unpaid tolls is not subject to complying with the FDCPA, a District Court judge in the Garden State rules last week. A plaintiff had sued a collection agency for attempting to collect on unpaid tolls by sending a collection letter which contained the individual’s account number in the envelope window.
