APPEALS COURT UPHOLDS SUMMARY JUDGMENT AGAINST COLLECTION AGENCY IN DEBT DISPUTE CASE
- The Fifth Circuit Court of Appeals has upheld a summary judgment ruling in favor of a plaintiff who sued a collection agency because it failed to mark a debt as disputed with the credit bureaus. The court ruled that even though the plaintiff did not follow proper procedures in disputing the debt, the defendant was still obligated to mark the debt as disputed with the credit bureaus.
FEDERAL JUDGE RULES BARCODE IN COLLECTION LETTER WINDOW NOT DISMISSED BY SPOKEO DEFENSE
- Including a barcode that can be scanned to provide account information in the window portion of an envelope is enough to satisfy the Spokeo test for determining concrete harm, according to a federal judge in New Jersey. The judge, Jose Linares, issued the ruling in the case of Stever v. Harrison. The defendant had filed a motion to have the class-action case dismissed. The ruling dismissed the defendant’s order.
OREGON LEGISLATURE PASSES BILL ADDING ADDITIONAL CONSUMER PROTECTIONS WHEN BEING SUED BY DEBT BUYERS
- The Oregon Senate on Wednesday passed a bill that adds additional requirements for debt buyers or collectors working on behalf of debt buyers when filing lawsuits against individuals. The bill now moves to Governor Kate Brown’s desk for her signature to become law.
MOST MEDIAN-INCOME HOUSEHOLDS CAN’T AFFORD A NEW CAR: STUDY
- Individuals earning a median income in only one of the 25 largest metropolitan statistical areas in the United States can afford to purchase a new car, according to an analysis conducted by Bankrate.com. Using a benchmark of a 20% downpayment, a four-year loan term, and a monthly principal/interest/insurance payment that takes up no more than 10% of the household’s gross income, only people in Washington, D.C., can afford to buy a new car. In Miami, for example, an individual earning a median income can only afford a vehicle worth $14,000.
