APPEALS COURT REVERSES DECISION IN COLLECTION LETTER DISPUTE
- The U.S. Court of Appeals for the Ninth Circuit has reinstated a lawsuit against a collection law firm for sending a collection letter that misstated the amount of principal and interest that was owed. A District Court had ruled in favor of the defendant, saying that the misstatement was not material. The Appeals Court disagreed, saying the least sophisticated consumer would have paid the balance in the letter.
