Schultz was previously sentenced to 30 months in prison in 2002 for not paying the Internal Revenue Service $1.26 million, and then sentenced  to six months on two separate occasions for still not paying the money. This time, the judge rejected the 366-day sentence for not being harsh enough. Schultz withdrew his guilty plea and now the case will head to trial.
