APPEALS COURT RULES AGAINST AGENCY FOR USING MILLER SAFE HARBOR LANGUAGE
- The Court of Appeals for the Seventh Circuit has reversed a lower court ruling and ruled against a collection agency for using safe harbor language that it had previously deemed usable, because the context in which the agency used the language was not applicable. A District Court had ruled that the agency did not violate the Fair Debt Collection Practices Act by using the language, but the Appeals Court disagreed.
BIG BANKS SUFFER BIG LOSSES ON CREDIT CARD DEBTS
- The four largest banks in the United States lost 20% more in their credit card portfolios in 2017 than they did in 2016, according to a published report. The 20% loss equates to about $12.5 billion, up from $10.5 billion a year earlier. The banks mentioned in the article are: Citigroup, Bank of America, JPMorgan Chase, and Wells Fargo.
ACA FILES AMICUS BRIEF IN TCPA CONSENT REVOCATION CASE BEFORE NINTH CIRCUIT
- ACA International said yesterday that it has filed an amicus brief in a lawsuit involving the revocation of consent as it pertains to alleged violations of the Telephone Consumer Protection Act. In this particular case, the District Court for the Central District of California ruled that a plaintiff did not use reasonable means to revoke consent from receiving text messages from the defendant because the plaintiff did not follow the proper instructions to have the communications halted.
