APPEALS COURT RULING STRIKES DOWN FCC’S CHANGES TO AUTODIALER DEFINITION, ONE-CALL SAFE HARBOR
- In what can be described as a win-win ruling, the Court of Appeals for the District of Columbia on Friday struck down some of the changes made to the Telephone Consumer Protection Act by the Federal Communications Commission in 2015. Based on the reaction from both ACA International, which sued the FCC immediately after the agency put forth the rules, and the FCC, both sides were happy with the outcome. As far as the ARM industry is concerned, the ruling set aside how the TCPA defines an autodialer and also struck down a one-call safe harbor, saying it was “arbitrary” and “capricious.”
WASHINGTON ENACTS STUDENT LOAN SERVICER LAW
- The governor of Washington last week signed a new bill into law that, among other things, will require servicers of student loans to obtain licenses and establish a number of responsibilities for servicers to follow.
