STRAUSSER FILES LAWSUIT AGAINST COMPANY THAT BOUGHT OUT HIS FIRM

  • Harry Strausser, one of the most well-known and well-respected professionals in the ARM industry, has filed a lawsuit against the man and the company who bought him out nearly a year ago. Strausser sold Remit Corp. to Eastern Revenue last May. Since then, Eastern has “hijacked” Remit’s business, only taking the most profitable clients and “dumping” the rest, according to a published report. OREGON AMENDS NEW DEBT BUYING, COLLECTION LAW TO CLARIFY WHO HAS TO PROVIDE DISCLOSURES

  • The Oregon legislature has passed a bill that seeks to amend the state’s new debt buying license and debt collection law by clarifying which types of organizations are required to provide individuals with certain types of information within 30 days of receiving a request. There were many concerns within the ARM industry when the new law went into effect in January because it provided no safe harbor language for what would happen to a collection agency or debt buyer if those documents were not able to be obtained within the 30-day window.

 

AGENCY TO TURN OVER $8.5M OF ACCOUNT TO GEORGIA AG AS PART OF SETTLEMENT OVER FDCPA VIOLATIONS

  • The attorney general of Georgia has announced an $8.5 million settlement with National Check Resolution, Inc., over charges that the collection agency violated the Fair Debt Collection Practices Act and the Georgia Fair Business Practices Act. The agency has agreed to stop collection activities on nearly 12,000 accounts, representing $8.5 million in unpaid debts. Those accounts will be turned over to the AG’s office.

 

W.V. AG SETTLES CASE OVER CREDITOR MAKING COLLECTION HOUSECALLS

  • The attorney general of West Virginia has reached a settlement with First Sentinel Bank after it was accused of violating the West Virginia Consumer & Credit Protection Act and other state and federal laws related to debt collection tactics. The bank was accused of engaging in “field visits” or “in-person” debt collection activities by going to the homes and places of work of individuals and attempting to collect from them personally.

 

APPEALS COURT RULES LOWER COURTS MUST FOLLOW FCC’S INTERPRETATION OF TCPA

  • The Fourth Circuit Court of Appeals has reversed a lower court ruling and said that District Courts must follow how the Federal Communications Commission interprets the Telephone Consumer Protection Act, and that they do not have the jurisdiction to determine whether to follow the FCC’s interpretation or not.

 

CFPB ISSUES RFI ON FINANCIAL EDUCATION ACTIVITIES

  • The Consumer Financial Protection Bureau has published its latest Request For Information, this time seeking input on its financial education activities. This is the 11th of 12 such RFIs that the CFPB has issued since it announced a comprehensive overview of all of its practices back in January.
