RETAILER HIT WITH TCPA CLASS-ACTION
- Aaron’s, a lease-to-own retail company, has had a class-action lawsuit filed against it for allegedly violating the Telephone Consumer Protection Act by contacting individuals believed to be debtors using an automated telephone dialing system. While a TCPA class-action in and of itself is not a man-bites-dog type of story, it is interesting to see how plaintiffs and their attorneys are incorporating the Court of Appeals for the D.C. Circuit’s ruling in ACA International v. FCC, especially as it relates to the use of autodialers.
FORMER OHIO AG PLANS OWN VERSION OF COMPLAINT DATABASE, IF IT GOES AWAY
- If the Bureau of Consumer Financial Protection decides to make its consumer complaint database private, the former Attorney General of Ohio is going to try and create a copy of the database that the public can have access to. Marc Dann, who was Attorney General of Ohio a decade ago, has already downloaded the existing database and posted it on his website.
AMERICANS KEEP SPENDING MORE ON CREDIT CARDS THAN THEY ARE PAYING OFF
- Americans paid off more than $40 billion in credit card debt during the first quarter of 2018, which is the highest amount paid off in nearly a decade, according to data compiled by the U.S. Census Bureau, TransUnion, the Federal Reserve, and WalletHub. That’s the good news. The bad news? All those payments didn’t make a dent.
COLLECTOR AGREES TO FORGIVE BALANCES ON 35,000 STUDENT LOANS
- The Attorney General of California has reached a settlement with a company that was attempting to collect on student loans made to individuals attending Corinthian Colleges after alleging that the company engaged in illegal debt collection activities. The company, Balboa Student Loan Trust, will stop collecting on about 35,000 loans, and the remaining balances will be forgiven, according to the settlement.
