APPEALS COURT RULES DEBT BUYERS MEET DEFINITION OF COLLECTORS UNDER FDCPA
- A ruling just issued by the Court of Appeals for the Third Circuit opines on the question – at what point does an entity become a debt collector? And can a debt collector ever go back to just being a debt buyer again? What ties this ruling together nicely with my little story is that the judge who wrote the opinion in this case — Judge Thomas Ambro — opens his opinion with a quote from Wimpy, the character from the Popeye cartoon series. Wimpy’s favorite line, for those who don’t remember it, was, “I will gladly pay you on Tuesday for a hamburger today.”
ARIZONA SUPREME COURT CREATES ‘BRIGHT-LINE’ TEST FOR STATUTE OF LIMITATIONS

APPEALS COURT RULES THAT TOLLS NOT SUBJECT TO FDCPA
- Even though an account number and a quick response code was visible in the window of its collection letter envelope, an Appeals Court has ruled that the collection agency which sent the communication did not violate the Fair Debt Collection Practices Act because what it was attempting to collect on — an unpaid highway toll — is not subject to the statute.
TREASURY DEPT. RELEASES AUDIT OF COLLECTION AGENCIES WORKING WITH IRS
- An audit of the four collection agencies collecting delinquent income tax debt on behalf of the Internal Revenue Service were largely given seals of approval, although the report did highlight a few areas that are in need of improvement.
