- Collection agencies should be setting up testing facilities in their offices to determine whether the calls they are making are being blocked by wireless carriers or apps that attempt to keep individuals from receiving robocalls, according to a panel of agency executives who spoke on the topic during a webinar last week. JUDGE DENIES MOTION TO DISMISS FDCPA CLASS ACTION OVER INSURANCE LANGUAGE IN LETTER
- A federal judge in New Jersey has denied a motion to dismiss a class-action lawsuit filed by a defendant that is accused of violating the Fair Debt Collection Practices Act by including language in a collection letter about having the plaintiff contact the defendant if he had medical insurance to cover the unpaid debt.

- A federal judge in Michigan has granted a partial summary judgment in favor of a defendant that was accused of violating the Telephone Consumer Protection Act, rejecting the plaintiff’s experience witness report and ruling that the Aspect System used by the defendant does not meet the definition of an automated telephone dialing system.
