CALIF. LEGISLATURE PASSES BILL IMPOSING SOL NOTIFICATION ON COLLECTORS
- Thanks to the folks at Maurice Wutscher, we know that the California legislature this week passed a bill that will require debt collectors to provide notification to individuals when attempting to collect a debt where the statute of limitations has expired. The bill, A.B. 1526, provides two different notifications that debt collectors can use when attempting to collect on a time-barred debt, depending on age of the debt.
BCFP REPORT EXAMINES TELECOM DEBT COLLECTION
- More than 22% of individuals have had a telecom debt on their credit report in the past five years, according to a report released by the Bureau of Consumer Financial Protection. Accordingly, telecom debt accounted for more than one-fifth of all collection agency revenue, according to the report. Of those furnishers that reported telecom debt to a credit reporting agency, 95% of them were either collection agencies or debt buyers.
JUDGE GRANTS SUMMARY JUDGMENT IN FAVOR OF PLAINTIFF IN TCPA CASE
- As pointed out by TCPAland.com, a District Court in the Northern District of Alabama has granted summary judgment in favor of a plaintiff alleging that a mortgage servicer violated the Telephone Consumer Protection Act by using a predictive dialer to make automated calls to the plaintiff.
