LACK OF CONSISTENCY IN TCPA RULINGS PRESENTS ISSUES FOR ARM INDUSTRY
- Fighting lawsuits alleging violations of the Telephone Consumer Protection Act continues to be an uphill climb, even though the total number of lawsuits is declining, said a panel of experts who spoke on a webinar on the topic last week. The webinar, which was sponsored by TCN, aimed to help collection agencies understand how to comply with the TCPA in their geographic footprint, given the varying rulings that courts have issued since the March ruling in ACA International v. Federal Communications Commission.
WELTMAN SEEKS $1.2M IN LEGAL FEES FROM BCFP
- Weltman Weinberg & Reis has filed a motion with the court to have the Bureau of Consumer Financial Protection cover the law firm’s attorney’s fees to defend itself in a lawsuit brought by the agency, which the law firm won last month. The firm is seeking $1.2 million to cover its legal fees for defending itself, according to the motion, which was filed last week with the District Court for the Northern District of Ohio.
IRS PRIVATE COLLECTION AGENCY PROGRAM NOW IN BLACK: REPORT
- The Private Collection Agency program being operated by the Internal Revenue Service is finally in the black, according to a report issued by the tax agency. The four collection agencies working on behalf of the IRS have brought in $50 million through the 2018 fiscal year, up to June 14, according to a report that was posted to the website of Sen. Chuck Grassley [R-Iowa], a member of the Senate Finance Committee, which oversees all tax-related matters. After expenses, the program has netted the IRS an additional $20 million, according to the report.
