JUDGE GRANTS SUMMARY JUDGMENT FOR DEFENDANT IN FDCPA CASE, RULING BONA FIDE ERROR WAS MADE

  • A District Court judge in Nevada has denied a plaintiff’s motion for summary judgment and instead granted summary judgment in favor of the defendant because its violation of the Fair Debt Collection Practices Act was not intentional and falls within the statute’s bona fide error defense.

COURT DENIES CERTIFICATION IN TCPA SUIT OVER COLLECTION CALLS

  • A District Court judge in California has declined to certify a class action lawsuit alleging a defendant violated the Telephone Consumer Protection Act by making collection calls to individuals who were not the intended recipients of the communications.

CFPB NOW CALLING TOWN HALL A ‘DEBT COLLECTION TOWN HALL’, ACA INTERNATIONAL CEO INVITED TO PARTICIPATE

  • The Consumer Financial Protection Bureau is now calling the Town Hall meeting it scheduled for May 8 in Philadelphia a “Debt Collection Town Hall” and ACA International has announced that Chief Executive Mark Neeb has been invited to participate at the meeting. This provides even more evidence that the CFPB is planning on releasing its proposed debt collection rule either in conjunction with the meeting or in advance of it.

NEW YORK CREATES OWN VERSION OF CFPB

  • The New York Department of Financial Services has created its own state-level consumer protection unit by combining two divisions into one.

WASHINGTON HOSPITAL NETWORK TO PAY $25M IN FORGIVENESS, REFUNDS, FINES AS PART OF CHARITY CARE SETTLEMENT

  • A group of eight hospitals in Washington State will forgive $20 million in unpaid medical bills, refund $2.2 million back to patients, pay $2.5 million to the state’s attorney general, and rehabilitate the credit of thousands of individuals who qualified for charity care but did not receive it, according to the terms of a settlement that was announced yesterday.
