Daily Digest – September 24. Judge Grants MTD in FDCPA Case Over Legal Description in Letter; Hospitals Getting Shortchanged on Reimbursements

JUDGE GRANTS MTD IN FDCPA CASE OVER DESCRIPTION OF LEGAL PROCESS IN COLLECTION LETTER

  • Calling a plaintiff’s argument “bordering on absurdity,” a District Court judge in Illinois has granted a defendant’s motion to dismiss after it was sued for allegedly violating the Fair Debt Collection Practices Act by sending a collection letter that said an attorney had not yet reviewed the circumstances of the case in question, but could do so at a later point and decide to file a lawsuit against the plaintiff, at which point the lawyer would ask for the court to enter a judgment against the plaintiff for the full amount owed.

REIMBURSEMENTS TO HOSPITALS USING OLD DATA FROM WHEN UNPAID DEBT TOTALS WERE LOWER: REPORT

  • Hospitals are facing a cash shortfall after it was announced that funding handed out through the government’s Disproportionate Share Hospital (DSH) program, which provides money to facilities that treat indigent individuals, will continue to be based on data from nearly five years ago, when hospitals had historically low levels of bad debt.

LAWSUIT TOTALS CONTINUE DECLINE, BUT SOME ‘TERRIFYING’ DATA STILL CAUSING PROBLEMS FOR COLLECTION AGENCIES

  • Collection agencies may not necessarily be noticing it, but there continues to be a precipitous drop in the number of lawsuits being filed alleging violations of the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, and the Telephone Consumer Protection Act, according to data released yesterday by WebRecon.

  • A North Carolina county is planning to deploy more “advanced collection methods,” including hiring collection agencies to help it recoup $28 million in unpaid ambulance bills.
