JUDGE GRANTS MOTION FOR DEFENDANT IN ‘ORIGINAL CREDITOR’ FDCPA CASE

  • A District Court judge in Washington has granted a defendant’s motion for judgment on the pleadings after it was sued in a class action for violating the Fair Debt Collection Practices Act because it allegedly did not reference the name of the creditor to whom the debt was owed in four collection letters.

BILL IN IDAHO WOULD REQUIRE WAITING PERIOD BEFORE PLACING MEDICAL DEBTS WITH COLLECTION AGENCY

  • A billionaire’s efforts to introduce a new state law in Idaho aimed at protecting individuals with medical debt appears to be ready to cross the goal line, with published reports indicating the introduction of a bill is imminent.

CRITICS BLAST PASSAGE OF CREDIT REPORTING REFORM BILLS

  • The House of Representatives yesterday passed a series of bills aimed at reforming credit reporting, including prohibiting the reporting of healthcare debts for procedures deemed to be medically necessary, and reducing the amount of time that late payments stay on an individual’s credit report.

DEMOCRATS GRILL IRS CHIEF ON PROTECTING LOW-INCOME INDIVIDUALS FROM PRIVATE COLLECTION AGENCIES

  • Sen. Elizabeth Warren, along with two other Senate Democrats and a Congressional Democrat, are calling on the Internal Revenue Service to better scrutinize the accounts that are being placed with one of four private collection agencies and to recall any accounts where the individual is not making enough money.
