JUDGE CERTIFIES CLASS IN FDCPA CASE OVER TAX DISCLOSURE

  • A District Court judge in New Jersey has certified a class against a company accused of violating the Fair Debt Collection Practices Act by sending collection letters which included a disclosure regarding the possible need to report the forgiveness of a debt to the Internal Revenue Service.

JUDGE QUASHES PROPOSED SETTLEMENT IN FCRA CASE

  • A District Court judge in Virginia has rejected the terms of a potential settlement in a Fair Credit Reporting Act class action because of “troublesome terms” that are tied to a “plan of action that the Court dimly understands.”

So I hold a special place in my heart for newspapers. And I fully understand that columns and opinions have their place in newspapers.   • Many states have taken action during the coronavirus pandemic to try and protect consumes, including issuing moratoriums on the issuance of new garnishments and protecting funds from stimulus programs that have been deposited into the accounts of individuals. But ProPublica has published an article that looks at individuals who had garnishments that were already in effect when the pandemic hit and how those individuals have continued to see their paychecks garnished. The article also mentions the “thousands’ of new lawsuits have been filed during the past three months, waiting for courts to re-open.

JUDGE DENIES MTD IN TCPA CASE OVER TEXTS SENT BY PRESIDENT’S RE-ELECTION CAMPAIGN

  • A federal judge in Minnesota has denied a motion to dismiss filed by the re-election campaign for President Trump, after it was accused of violating the Telephone Consumer Protection Act by allegedly sending text messages using an automated telephone dialing system without first obtaining the proper consent to do so.
