JUDGE DENIES MOTION BECAUSE CREDITORS’ TERMS DO NOT SPECIFICALLY MENTION DEFENDANT

  • A District Court judge in Texas has denied a defendant’s motion to dismiss a complaint and compel arbitration because the terms of the agreement between the original creditor and the plaintiff did not specifically name the defendant, even thought it did say the agreement included “our controlled subsidiaries, assignees, and agents.”

CALIF. CFPB SHELVED FOR NOW, BUT STILL COULD BE ADDED BACK TO STATE’S BUDGET

  • As the California legislature works on approving a budget for the coming fiscal year, it still remains to be seen whether a proposed state version of the Consumer Financial Protection Bureau will come to life or not, according to a published report. Staring at a deadline of yesterday to submit an updated budget to the governor’s office, negotiators opted not to include a new Department of Financial Protection and Innovation, although it could still be added back into the budget before it is finalized.

WASH. STATE BOARD RESCHEDULES VOTE ALLOWING COLLECTORS TO KEEP WORKING FROM HOME

  • It appears as though a measure in Washington state that would clarify state regulations on what constitutes a branch office in order to allow employees of collection agencies to work from home has been postponed until September.

D.C. AG SUES ONLINE LENDER

  • The Attorney General of Washington, D.C., has filed suit against an online lender for allegedly charging interest rates at 42 times the allowed limit in the District and for not being a licensed lender.
