N.J. APPEALS COURT UPHOLDS RULING IN COLLECTION CASE
- Which is more wrong? Mistakenly filing a lawsuit after the statute of limitations has expired because you relied on information from a third-party collection agency or ignoring a default judgment for nearly a decade before doing something about it? A state Appeals Court in New Jersey has ruled the former is a bigger issue than the latter in affirming a lower court’s ruling that a debt buyer should not have been able to file a lawsuit to collect on an unpaid debt because the statute of limitations had expired.

- Rendered unable to argue that she was confused about whether a debt dispute could be made in writing or over the phone thanks to a recent ruling, a plaintiff was also unsuccessful in claiming that the phrase “Validation Notification” at the top of the letter overshadowed her right to dispute the debt, the Court of Appeals for the Third Circuit has ruled.
CONSUMER GROUPS SUE CFPB OVER TASKFORCE COMPOSITION
- A group of consumer advocates have filed a lawsuit against the Consumer Financial Protection Bureau, alleging it has “stacked” a taskforce with individuals who “uniformly represent industry views” and whose bias not only undermines its purpose but also violates the Federal Advisory Committee Act.
N.Y. EXTENDS COLLECTION MORATORIUM
- Even though it has begun to relax some of the restrictions put in place in response to the coronavirus pandemic, the Attorney General and Governor of New York have re-extended a 30-day moratorium on debt collection activities that are owed to the state, including student loans and medical debts.
