JUDGE GRANTS MTD IN FDCPA CLASS ACTION OVER INCLUSION OF TAX DISCLOSURE IN LETTER
- A District Court judge in New Jersey has granted a defendant’s motion to dismiss after it was sued in a Fair Debt Collection Practices Act class action for including a disclosure about the possible tax consequences of a debt forgiveness offer, even though the amount being forgiven was $40 and for allegedly not identifying the current creditor to whom the debt was owed.
BILL INTRODUCED IN SENATE THAT WOULD END LICENSE SUSPENSIONS FOR UNPAID DEBTS
- A bipartisan bill has been introduced in the Senate that would end a program that prohibits states from receiving federal funds for highway projects unless they agree to suspend the driver’s licenses of individuals with unpaid debts.
