JUDGE GRANTS MOTION FOR DEFENDANT IN FDCPA LETTER CASE, DENIES MOTION FOR ATTORNEY’S FEES

  • A District Court judge in New York has granted a defendant’s motion for judgment on the pleadings, but denied its motion for defense fees under the Fair Debt Collection Practices Act’s fee-shifting provision, after it was sued in a class-action for allegedly misleading the plaintiff about to whom a settled debt would be reported to, marking the second time the plaintiff’s counsel has filed such a lawsuit.

EMPLOYEE PUSHBACK LEADS CFPB TO HALT PLANNED REORGANIZATION

  • The Consumer Financial Protection Bureau has shelved plans to reorganize its supervision and enforcement units, according to a published report, after receiving feedback from within the agency that the moves were not a good idea.

HOUSEHOLD DEBT INCREASES DURING 3Q, BUT NUMBER OF CONSUMERS WITH DEBT IN COLLECTION PLUMMETS

  • The number of individuals with an account that has been placed with a collection agency continued to hit record lows in the third quarter, even as the average collection amount per person increased, according to data released yesterday by the Federal Reserve Bank of New York. Less than 8% of consumers had a debt in collection during the third quarter, which is the lowest that figure has been in the 17 years that the bank has been tracking the data. This correlates to anecdotal evidence that I have been hearing that placement volumes at agencies have slowed significantly in recent weeks.

HHS FINES PROVIDERS FOR NOT PROVIDING MEDICAL RECORDS; WHY COLLECTORS NEED TO PAY ATTENTION

  • The Department of Health and Human Services’ Office of Civil Rights has fined two more healthcare providers for violating the Health Insurance Portability and Accountability Act (HIPAA) for not providing individuals with access to their medical records, which could intersect with the Fair Debt Collection Practices Act for any agency that is working healthcare accounts.

NATIONAL DEBT HOLDINGS DONATES TO OCEAN CONSERVANCY THIS HOLIDAY SEASON
