AGs SEEK TO STOP SETTLEMENT IN FDCPA PROCESSING FEE CASE

  • A group of 33 state attorneys general are attempting to intervene and stop a settlement in a class-action Fair Debt Collection Practices Act case in which a mortgage servicer was accused of charging processing fees when taking payments over the phone or via its website.

CONSUMER ADVOCATES, STATE AGs LINE UP BEHIND PLAINTIFF IN TCPA ATDS APPEALS CASE

  • Consumer advocacy groups and 33 state attorneys general have lined up behind the plaintiff in a Telephone Consumer Protection Act case currently before the Sixth Circuit Court of Appeals that will determine whether calls made to an individual’s cell phone using an automated telephone dialing system before July 6 relinquished the court’s subject matter jurisdiction over the claims.

  • Hospitals across the country are using century-old lien laws to increase their revenue when treating victims of accidents, such as car crashes, by bypassing the discounts that are normally provided to health insurance companies, according to a report. The practice is “so lucrative” that some hospitals use debt collection companies to “scour police records” for the names of accident victims to see if they are treating any of them and can pursue a lien instead of billing their health insurance, according to the report.

GAO REVIEWS COST-BENEFITS OF DEBT COLLECTION RULE

  • The Government Accountability Office has issued a report analyzing the Consumer Financial Protection Bureau’s compliance with procedural steps related to its release of the debt collection rule, which the GAO is required to perform and provide to both houses of Congress.

TRANSUNION MAKES CASE TO DECERTIFY CLASS IN $40M FCRA CASE

  • A credit reporting agency has filed its brief with the Supreme Court as it seeks to have a class of plaintiffs decertified in a Fair Credit Reporting Act case that will answer the question of whether every member of a class must have Article III standing in order to recover damages, which could significantly impact the future of class actions across the country.
