OPTIMISM ABOUNDS AT DAY 1 OF RMAI’S ANNUAL CONFERENCE
- Hugs, handshakes, fist bumps, elbow bumps, and everything in between. Those were in full effect yesterday in and around the Aria Resort & Casino here as RMAI’s annual conference kicked off with hundreds of masked attendees seeing each other for the first time in a year or more. With plenty of talk and content focused on Regulation F — the Consumer Financial Protection Bureau’s Debt Collection Rule — the industry tried to pick up right where it left off more than a year ago with the national trade associations stopped hosting in-person events because of the COVID-19 pandemic. And, for the most part, the industry did pick up right where it left off, thanks to RMAI’s emphasis on the health and safety of those attending the event.

JUDGE RULES ATTORNEYS’ FEES DISCOVERABLE IN FDCPA CLASS ACTION
- In a case that is being defended by the team at Malone Frost Martin, a District Court judge in Texas has granted a defendant’s motion to compel documents related to the plaintiff’s attorneys’ fees, costs, fee arrangements, and billing records in a Fair Debt Collection Practices Act class-action lawsuit, ruling that the information is discoverable.
FCC ANNOUNCES ACTIONS TO COMBAT ILLEGAL ROBOCALLS
- The Federal Communications Commission undertook a number of actions yesterday related to blocking illegal and unwanted robocalls, including sending cease and desist letters to two carriers that “appear to be transmitting multiple unlawful robocall campaigns” and seeking updated information from all carriers and developers of call-blocking tools to learn more about the tools available to consumers and their effectiveness.
DEBT SETTLEMENT FIRM TO PAY $1.4M IN FINES AND REDRESS IN AGREEMENT WITH CFPB
- The Consumer Financial Protection Bureau yesterday announced an enforcement action against a debt settlement company that has ties to the very creditors it was trying to help consumers get out of debt from, fining the company $750,000 and ordering it to repay $646,000 back to its customers.
