HUNSTEIN RULING MAKES APPEARANCE IN FCRA DECISION OVER LACK OF STANDING
- The web of rulings spiraling out of the Eleventh Circuit Court of Appeals’s decision in Hunstein v. Preferred Collection & Management Services is beginning to be woven, this time in a Fair Credit Reporting Act case. But in this case a District Court judge determined the plaintiff did not have standing to accuse a potential employer of violating the FCRA by procuring a credit report on the members of the class without first providing a lawful disclosure and granted the defendant’s motion for summary judgment.
JUDGE GRANTS MTD FOR FIRST-PARTY COLLECTOR IN FDCPA CASE
- A Magistrate judge in Texas has recommended that a Fair Debt Collection Practices Act case against a first-party debt collector be dismissed because the plaintiff did not do enough to argue that the defendant meets the definition of debt collector under the statute.
BILL INTRODUCED TO AMEND FCRA TO PROTECT SERVICEMEMBERS
- A bill has been introduced in the House of Representatives that would amend the Fair Credit Reporting Act to install additional protections for servicemembers on active duty or who are deployed in a combat zone or on a ship.
FCC PROPOSES NEW STIR/SHAKEN COMPLIANCE DATE FOR ROBOCALL FACILITATORS
- The Federal Communications Commission, in another effort to crack down on the volume of illegal robocall traffic, is seeking comment on a proposal to reduce the amount of time that small voice service providers would have to implement Caller ID authentication technology under the STIR/SHAKEN protocols if those providers are deemed to be facilitating robocall traffic.
