MARYLAND HEALTHCARE COLLECTION BILL BECOMES LAW
- By virtue of not signing it into law or vetoing it while it sat on the governor’s desk for 30 days, healthcare debt collection legislation in Maryland has become law, which, while not as restrictive as it was when it was introduced, will still require healthcare providers and debt collectors working medical debt accounts to make changes to their processes going forward. Most of the bill went into effect on June 1. The remaining portion is due to go into effect on January 1, 2022.
JUDGE PARTIALLY GRANTS MSJ FOR DEFENDANT IN FDCPA CASE OVER BK FILING
- A Magistrate Court judge in Indiana has partially granted a defendant’s motion for summary judgment, but denied other claims it violated the Fair Debt Collection Practices Act by sending a collection letter to individuals who had filed for bankruptcy protection and had requested that the defendant stop communicating with them.
DFPI ISSUES ALERT ABOUT FIRM ‘POSING’ AS LEGAL DEBT COLLECTOR
- The Department of Financial Protection and Innovation in California has issued a consumer alert, notifying the public that The Offices of Morgan and Moss is “holding itself out as a legitimate debt collector” in California, and is using “threatening and abusive tactics to coerce consumers to make payments on ‘debts’ that have not been verified, do not belong to the consumer, and/or cannot be legally collected upon.”
TENN. COURT OFFERING ONLINE TOOL TO HELP SETTLE MEDICAL DEBT DISPUTES
- A pilot program is being offered in Tennessee aimed at reducing the number of medical debt collection lawsuits that are filed against individuals, by offering a free online medical debt resolution platform for healthcare providers and consumers to use to work out settlements before lawsuits are filed. The platform is even offering free access to licensed mediators to help find solutions to unpaid medical bills.
