WDTN JUDGE USES TRANSUNION RULING TO GRANT MTD IN FDCPA CASE OVER DEBT AMOUNT
- A District Court judge in Tennessee is the latest to use the Supreme Court’s ruling in TransUnion v. Ramirez as grounds to determine that a plaintiff lacked standing to sue a collector for allegedly violating the Fair Debt Collection Practices Act because it indicated in a collection letter that additional fees could be added to the balance that was due.

- In what may be a case of mistaken identity or a case of a first-party collector doing its job properly, a District Court judge in New York has granted a defendant’s motion to dismiss after it was sued for violating the Fair Debt Collection Practices Act because it allegedly sent a collection letter that included the logo, a mailing address, a payment website address, and signature of a creditor, ruling that the plaintiff did not do enough to allege that the defendant actually sent the letter.
BIDEN ADMINISTRATION BEGINS IMPLEMENTATION OF LAW BANNING SURPRISE MEDICAL BILLS
- The Departments of Health and Human Services, Labor, and Treasury have issued an Interim Final Rule as part of a law passed under former President Donald Trump that will limit “surprise” medical bills assessed to patients who are unknowingly treated by doctors and facilities that are outside of the patients’ healthcare networks. The issuance of the rule, which is scheduled to go into effect on Jan. 1, 2022, is the first step toward the enactment of the “No Surprises Act” which Congress passed last year.

- One of the biggest problems for companies in the accounts receivable management industry in recent months has been finding qualified applicants and candidates who are willing to work.
