COLORADO ISSUES OPINION CLEARING UP DISCLOSURE CONFLICT WITH REG F
- Colorado’s Department of Law issued an advisory opinion yesterday attempting to clear up a conflict between disclosures to consumers required under its state collection law and disclosures required under Regulation F.
JUDGE APPLIES FN7 TO DISMISS TCPA CLAIM AGAINST COLLECTOR, BUT DENIES MTD ON FDCPA CLAIM
- A District Court judge in California has granted a defendant’s motion to dismiss claims it violated the Telephone Consumer Protection Act when it contacted an individual on his cell phone to attempt to collect on an unpaid debt because the defendant did not use an automated telephone dialing system, but denied the defendant’s motion to dismiss claims that it violated the Fair Debt Collection Practices Act because it does not meet the definition of debt collector under the statute.
CFPB, DOJ ISSUE WARNINGS TO LANDLORDS, SERVICERS ABOUT DEALING WITH SERVICEMEMBERS, VETERANS
- The Consumer Financial Protection Bureau and Department of Justice yesterday put landlords and mortgage servicers on notice about how to handle protections for servicemembers and their families with regard to the COVID-19 pandemic by following the CARES Act and the Servicemembers Civil Relief Act.
SCAM CALL VOLUME DOUBLES IN 2021: T-MOBILE
- The number of scam call attempts per month more than doubled from the start of 2021 to the end, according to a report that was released yesterday by T-Mobile. The cellular carrier revealed that there were 2.5 billion scam call attempts in November, compared with 1.1 billion in January. Also, the most frequent reason why you received scam calls was for fake car warranties, which accounts for 51% of all scam calls this year.
