JUDGE DENIES MSJ FOR DEFENDANT IN TCPA CASE OVER WHETHER CONSENT WAS REVOKED
- A District Court judge in Kentucky has partially granted — and partially denied — a defendant’s motion for summary judgment in a Telephone Consumer Protection Act case, ruling that a plaintiff’s request to have information sent to him via the mail rather then delivered over the phone, coupled with refusing to talk to a collector and hanging up the phone on a subsequent call and not answering the phone when the defendant called after that raises a genuine issue of whether the plaintiff revoked consent to be contacted, even if he never specifically said so.
AVERAGE TAX REFUND UP 15% YOY WHILE PROBLEMS AT IRS PERSIST
- There is good news and bad news about income tax filing season. The good news is that the average refund through the first month of income tax season is 15% higher than the average refund through the same period a year ago. The bad news is that problems at the agency with respect to staffing levels, processing a backlog of paper returns, and having enough staplers is making a bad situation at the Internal Revenue Service even worse.
SURVEY REVEALS EXTENT OF MEDICAL DEBT BURDENS PLACED ON AMERICANS
- More than 50% of all Americans owe some amount of healthcare debt, and more than 20% owe at least $10,000, according to the results of a survey that were published last week by AffordableHealthcare.com. Making the data even more striking was the fact than 61% of respondents who say they have health insurance through their employers still carry some amount of medical debt. Forty-four percent of respondents said their medical debts are being worked by a collection agency.
