JUDGE DENIES COMPETING MOTIONS IN FDCPA, TCPA CASE
- A District Court Judge in Nevada has denied competing motions for judgment on the pleadings filed by both the plaintiff and defendant in a Fair Debt Collection Practices Act and Telephone Consumer Protection Act case about calls that were made to the plaintiff by the defendant after the debt had been settled.
CRAS START TO RELEASE DETAILS ABOUT CHANGES TO REPORTING PROCESS FOR MEDICAL DEBTS
- The announcement last week from the three major credit reporting agencies — Equifax, Experian, and TransUnion — was long on impact, but short on details. All that was issued was a press release that mentioned that the CRAs were doing, but did not include any details about how furnishers were going to have to change their operations. That changed yesterday, when Equifax sent out an email to its furnishers, providing some information about what they will need to do in order to comply with the new requirements.
CFPB ISSUES COMPLIANCE BULLETIN RELATED TO ONLINE CONSUMER REVIEWS
- The Consumer Financial Protection Bureau yesterday issued a compliance bulletin aimed at ensuring that consumers have the right and opportunity to post honest reviews about financial products and services that accurately reflect their opinions and experiences. The bulletin warns companies in the financial services industry that they may be found guilty of an Unfair and Deceptive Act or Practice in violation of the Consumer Financial Protection Act if they seek to suppress or silence consumers from posting online reviews.
