JUDGE DENIES MOTION TO REMAND FDCPA CASE BACK TO STATE COURT; GRANTS MTD
- A District Court judge has denied a plaintiff’s motion to remand a Fair Debt Collection Practices Act case back to state court while also granting the defendant’s motion to dismiss, ruling that the plaintiff had standing to sue in federal court, but did not state a claim on which the case could be based.
N.Y. LEGISLATURE PASSES ANTI-GARNISHMENT, ANTI-LIEN BILL FOR CERTAIN MEDICAL DEBTS
- The New York Senate yesterday voted to approve a bill that would protect individuals from having liens placed on their primary residences and having their wages garnished to repay medical debts. The New York Assembly had already passed its version of the bill, and consumer advocates yesterday called on Gov. Kathy Hochul to sign the proposed legislation into law.
