‘LEAST SOPHISTICATED CONSUMER’ ALLEGATIONS NOT ENOUGH FOR PLAINTIFF TO HAVE STANDING
- After receiving a letter that included a collection charge, a statement that the debt would be reported to the credit reporting agencies, and the name of the defendant viewable through the glassine window of the envelope, the plaintiff filed suit, alleging a least sophisticated consumer would be harmed by the alleged violations.
- But because the plaintiff never suffered a concrete injury, she doesn’t have standing to sue, a judge has ruled.

HEALTHCARE PROVIDER, COLLECTION AGENCY FACING CLASS-ACTION FOR ALLEGEDLY VIOLATING STATE LAW
- New Mexico enacted a law last year preventing healthcare provider from engaging in certain collection activities with individuals who make 200% less than the federal poverty limit.
- A group of 200 plaintiffs are suing a healthcare provider and the agency working on its behalf for not following that law.
