DEFENDANT ACCUSED OF VIOLATING 7-IN-7, SAYING DEBT MUST BE PAID IN FULL
- A collection law firm is being accused of violating the Fair Debt Collection Practices Act because it allegedly told an individual that a payment plan was not available and that he must pay the debt in full and for not stopping communications after the individual allegedly demanded that the defendant stop communicating via phone calls and text messages while also allegedly informing the plaintiff that the only way the calls would stop was if the debt was paid.

CALIFORNIA TO START ISSUING CONDITIONAL LICENSES JAN. 1; SAFE HARBOR TO EXPIRE DEC. 31
- The California Department of Financial Protection and Innovation plans to start issuing conditional licenses to companies that have applied under the state’s debt collection licensing law on January 1, 2023, and will end the safe harbor allowing companies that have applied for a license to continue to collect in the state at the same time, the agency announced yesterday during a virtual meeting of its Debt Collection Advisory Committee.

JUDGE CERTIFIES CLASS AGAINST DEFAULTED DEFENDANT IN FDCPA CASE
- A District Court judge in Mississippi has certified a class action in a Fair Debt Collection Practices Act case in which the plaintiff has already obtained a default judgment against the defendant, after the defendant allegedly sent letters to the plaintiff that did not have the proper disclosures on them.

BILL INTRODUCED IN HOUSE TO RAISE GARNISHMENT PROTECTIONS
- A bill has been introduced in the House of Representatives that seeks to amend the Consumer Credit Protection Act and protect more of consumers’ wages from garnishment while also amending the Fair Debt Collection Practices Act to prevent collectors from taking any action, including making threats, of having consumers arrested or imprisoned in connection with the collection of a debt.
