BK JUDGE SUBSTANTIALLY REDUCES FEE AWARD IN DECADE-LONG FDCPA CASE
- I will admit that I scrolled past this ruling the first time I saw it — largely because it had to do with a mortgage foreclosure and because the ruling itself is really long (and I mean really long) — but someone who knows a lot more about the law in this industry pointed it out so I am circling back to share it with all of you. A bankruptcy court judge in Texas has reduced the fee award in a case that involved two trials — one on the underlying facts of the case and a second on the amount of attorney’s fees that should be awarded — to about $285,000 from the original request of $874,068.

- We have been talking about collectors taking payments via apps like Venmo and PayPal for quite a while now, and new data has been released showing just how much money consumers are storing in payment apps, be they for specific merchants (like Starbucks) or on general purpose apps. While we could turn the phrase “consumer preference” into a drinking game on webinars related to communication channels, the phrase is not used as profusely when it comes to discussing payment channels, and perhaps it needs to be.

JUDGE DENIES DEFENDANT’S MSJ IN FCRA CASE OVER DISPUTED TRADELINE
- A District Court judge in Illinois has denied a defendant’s motion for summary judgment in a Fair Credit Reporting Act case, ruling that it did not meet its burden proving it conducted a reasonable investigation after the plaintiff submitted a dispute regarding an item on her credit report.
