JUDGE ARTFULLY DISMISSES FDCPA SUIT OVER RECEIPT OF VERIFICATION LETTER
- Reading as many rulings from judges as I do, you tend to appreciate those with some style and Judge Michael T. Liburdi of the District Court for the District of Arizona definitely has some style. In dismissing a Fair Debt Collection Practices Act case for lack of standing while also chiding the defendant for a lack of “self-awareness” in seeking attorney’s fees and costs, Judge Liburdi goes to great lengths to detail why the receipt of a letter — one which the plaintiff requested — is not enough for the plaintiff to have suffered a concrete injury.

CFPB FINES BANK $9M FOR FAILING TO PROPERLY MANAGE CREDIT CARD DISPUTES, FRAUD CLAIMS
- The Consumer Financial Protection Bureau yesterday announced a $9 million settlement with Citizens Bank over a lawsuit that was filed in 2020 accusing the financial services giant of failing to properly manage disputes and fraud claims filed by the bank’s credit card customers. Along with paying the fine, the bank will also have to update its policies and procedures to prohibit employees from requiring customers to provide a fraud affidavit — filed under the penalty of perjury — when filing a credit card claim.

RCM PROVIDER TO PAY $550K TO SETTLE DATA BREACH ENFORCEMENT ACTION
- The Attorney General of New York has settled an enforcement action against a revenue cycle management company that will see the company pay $550,000 in fines and penalties after it was accused of failing to protect the personal information of individuals that lead to a ransomware cyberattack which affected more than 1.2 million consumers nationwide and 428,000 living in New York.
