CLASS-ACTION FILED FOR FAILING TO PROVIDE VALIDATION INFORMATION IN LETTER
- A plaintiff has filed a class-action lawsuit, accusing a mortgage servicer of violating the Fair Debt Collection Practices Act because a letter that he received informing him that he was in default and the holder of the loan intended to foreclose did not include validation information, even though the complaint makes no mention of whether the letter was the initial communication between the two parties.

APPEALS COURT GRANTS EN BANC REQUEST IN FDCPA CASE
- The Court of Appeals for the Ninth Circuit has granted an en banc rehearing request filed by a collector in a Fair Debt Collection Practices Act case, and will determine for itself whether the plaintiff had standing to file his lawsuit in the first place, rather than remanding the case back to the District Court to make that determination.
