Consumers, Advocates to Get Say in CFPB’s Open Banking Standard

The Consumer Financial Protection Bureau has finalized a rule that outlines the qualifications for becoming a recognized standard-setting body. These bodies will play a crucial role in helping companies comply with the upcoming Personal Financial Data Rights Rule. This move aims to accelerate the transition to open banking in the United States, ensuring a fair and competitive environment for consumers and financial institutions alike.

The finalized rule sets forth specific attributes that standard-setting bodies must demonstrate to gain CFPB recognition. These attributes include:

  1. Openness: The standard-setting process must be open to all interested parties, including public interest groups, app developers, and a wide range of financial firms. This ensures that no single entity can dominate the standards development process.
  2. Transparency: All procedures must be transparent and publicly available, allowing participants and the public to access relevant information.
  3. Balanced Decision-Making: Decision-making power must be balanced across all interested parties, ensuring meaningful representation for both large and small entities. No single interest can dominate the process.
  4. Consensus: Standards must be developed through a consensus process, considering comments and objections fairly and impartially.
  5. Due Process and Appeals: Documented policies and procedures must be in place for resolving conflicts and appeals, ensuring a fair process for all participants.

Application and Evaluation Process

The CFPB has provided a step-by-step guide for standard-setting bodies to apply for recognition. This includes submitting evidence of their policies and practices, demonstrating how they meet the CFPB’s attributes, and potentially undergoing public comment and additional information requests. Recognized bodies must reapply every five years, ensuring continuous adherence to the CFPB’s standards.

Impact and Importance

CFPB Director Rohit Chopra emphasized the importance of preventing dominant firms from manipulating industry standards to maintain their market position. By establishing these rules, the CFPB aims to promote competition and innovation in the financial sector. The rule is part of a broader effort to implement the personal financial data rights established by Congress in 2010, which have not fully taken effect due to the absence of a formal rule until now.

The rule has garnered various reactions from industry stakeholders. Consumer advocates have praised the inclusion of consumer groups in the standard-setting process, while some industry groups have sought clarifications and adjustments to the proposed attributes. The CFPB’s final rule addresses these concerns by providing detailed definitions and maintaining flexibility in recognizing standard-setting bodies.
