Judge Grants MTD in FDCPA Case Over Worker’s Comp Debt

A District Court judge in Florida has granted a defendant’s motion to dismiss a Fair Debt Collection Practices Act case involving a worker’s compensation claim because the plaintiff failed to sufficiently allege a concrete injury, thus lacking the necessary standing to pursue the lawsuit.

The Background: The case originated from a workplace injury suffered by the plaintiff on January 3, 2021. On July 1, 2021, the plaintiff sought emergency treatment for this injury at a hospital owned and operated by a healthcare company.

  • Despite the plaintiff not being financially responsible for treatment of a workplace injury under Florida law, the healthcare company sent the plaintiff a bill totaling $1,337.33 for the treatment received.
  • In February 2022, the plaintiff filed a lawsuit against the healthcare company in state court for unlawfully demanding payment. This lawsuit was settled in October 2022.
  • However, despite the resolution of the state lawsuit, the healthcare company contracted with the defendant debt collection agency to collect the medical debt from the plaintiff.
  • The defendant sent a collection letter to the plaintiff on July 29, 2023, demanding payment for the medical debt. This prompted the plaintiff to file the FDCPA lawsuit, alleging that the defendant violated the FDCPA by falsely representing the character and amount of the debt.

The Ruling: Judge Beth Bloom of the District Court for the Southern District of Florida determined that the plaintiff’s allegations of wasted time and money were too conclusory. The complaint did not specify how much time or money was spent dealing with the collection letter, nor did it detail any further interactions between the plaintiff and his attorney beyond delivering the letter. Similarly, the plaintiff’s claims of emotional distress, such as anxiety and loss of sleep, lacked sufficient detail to establish a concrete injury. While emotional distress can sometimes constitute a tangible injury, it must be supported by specific facts, which were absent in this case, Judge Bloom noted.

  • Furthermore, the plaintiff’s assertion that the collection letter constituted an invasion of privacy was insufficient because one debt collection letter does not amount to an intrusion upon seclusion as traditionally recognized at common law, Judge Bloom wrote.
  • Given these deficiencies, the court granted the defendant’s motion to dismiss for lack of standing. However, the dismissal was without prejudice, allowing the plaintiff an opportunity to amend the complaint to address the identified shortcomings. The plaintiff has until July 16 to file an amended complaint.
