Judge Grants Partial Summary Judgment to Both Sides in FDCPA Case Over Judgment

A District Court judge in Nevada has granted partial summary judgment to both the plaintiff and the defendant in a Fair Debt Collection Practices Act case, ruling that while the defendant’s actions in obtaining a default judgment were improper, the subsequent attempts to collect the debt were permissible under the law.

The Background: The case originated from a default judgment obtained by the defendant in Nevada state court in 2009, which was subsequently renewed in 2022. The defendant, a debt collection agency, claimed that the plaintiff owed $12,490.70 plus 12% annual interest from a Chase Bank credit account. The plaintiff, however, asserted that she had only started banking with Chase in 2019 and did not own the account in question.

  • In 2009, the defendant served its complaint on a “Jane Smith” at the plaintiff’s former property. After the plaintiff failed to respond, the defendant obtained a default judgment for the principal amount plus interest and attorney’s fees. In 2022, the defendant renewed the judgment, which had grown to $32,050.44 with accrued interest. The plaintiff only became aware of this judgment when the defendant placed a lien on her home in May 2022.
  • The plaintiff filed suit, alleging that the defendant’s actions prevented her from selling her home and caused her emotional distress.

The Ruling: Judge Gloria M. Navarro of the District Court for the District of Nevada, ruled the defendant falsely represented the plaintiff’s ownership of the debt without producing the necessary agreement when it filed the underlying collection lawsuit. The court concluded that the defendant’s actions in the original state court proceeding constituted a misrepresentation that violated the FDCPA.

  • However, Judge Navarro also granted partial summary judgment to the defendant regarding its subsequent collection efforts. The judge determined that once the default judgment was in place, the defendant was legally permitted to attempt to collect the debt, including placing a lien on the plaintiff’s home. The court found no evidence of improper conduct in these collection efforts, as they were based on a valid court judgment.
  • The defendant’s attempt to invoke the FDCPA’s bona fide error defense was also rejected. Judge Navarro found that the defendant did not provide sufficient evidence of maintaining procedures reasonably adapted to avoid the error in question.
