Plaintiff Sues for Collector Not Removing Dispute Flag, then For Not Adding it Back
- It can be really hard sometimes to determine whether a plaintiff is playing games in an attempt to win a lawsuit or get a collector to stop collecting a debt or if there is a legitimate complaint. This is one of those circumstances. The plaintiff in this lawsuit checked her credit report in March and saw a tradeline furnished by one of the defendants. The tradeline indicated the debt was being disputed, which the plaintiff didn’t remember doing.

Judge Dismisses FDCPA Case Over Failure to Report Dispute for Lack of Standing
- A District Court judge in New York has dismissed a Fair Debt Collection Practices Act case, ruling the plaintiff did not have standing to sue because he did not allege to have suffered any concrete injuries in his complaint, which accused a collection operation of allegedly not marking his account as disputed with the credit reporting agencies.
