Seventh Circuit Overturns Ruling for Defendant in FDCPA Case Involving Disputed Debt

The Court of Appeals for the Seventh Circuit has overturned a lower court’s ruling in favor of the defendant in a Fair Debt Collection Practices Act case, ruling that the defendant’s lack of knowledge about a prior dispute did not absolve it of its obligations under the FDCPA. The case highlights the interplay and confusion between disputes under the FDCPA and the Fair Credit Reporting Act.

The background: The case stems from a disputed credit card debt originally held by a credit union. The plaintiff had formally disputed the debt with the credit union, which responded by verifying the debt and indicating that the debt would remain on the plaintiff’s credit report.

  • The plaintiff did not respond further, and the credit union subsequently sold the debt to the defendant. As part of the sale agreement, the credit union represented that none of the accounts being sold had unresolved disputes.
  • After acquiring the debt, the defendant began reporting it to the credit reporting agencies but did not indicate that the debt had previously been disputed.
  • The plaintiff then filed suit, arguing that the failure to report the dispute violated the FDCPA.
  • The lower court ruled in favor of the defendant, determining that it had no way of knowing about the prior dispute and, therefore, could not have acted improperly.

The ruling: The Seventh Circuit reversed the lower court’s decision, holding that the FDCPA requires debt collectors to conduct reasonable investigations before reporting debts to credit agencies. The court reasoned that even though the defendant was not explicitly informed of the prior dispute, it had a duty to verify whether any disputes had previously been raised before furnishing data to the credit bureaus.

  • The original creditor was not bound by the FDCPA and the Court ruled that the answers to whether the original creditor’s duty to report the debt as disputed under the FCRA was the same as the defendant’s duty to report it under the FDCPA.
  • The ruling highlights the court’s interpretation of standing and injury under the FDCPA. The court noted that furnishing inaccurate or incomplete information to credit reporting agencies can create an “intangible, reputational injury” that is sufficient to establish standing.
  • The appellate court drew on precedent, stating, “A debt collector cannot simply claim ignorance when the information in its possession would suggest the need for further inquiry.” This statement reinforces the notion that debt collectors bear responsibility for ensuring the accuracy of the information they report.
