Sixth Circuit Upholds Ruling in FDCPA Case, But On Different Grounds

The Court of Appeals for the Sixth Circuit has affirmed a lower court’s summary judgment ruling in favor of a defendant in a Fair Debt Collection Practices Act case, agreeing that the plaintiff lacked standing to sue, but on different grounds, even though the plaintiff suffered a monetary injury.

The background: The case stemmed from a foreclosure action initiated by the defendant after acquiring a mortgage loan that had been in default for several years. The plaintiff, who had taken out a second mortgage on her home in 2003, stopped making payments in 2013 or 2014. When the defendant acquired the loan in 2018, it pursued foreclosure, but the case was dismissed without prejudice in 2019 after the defendant’s attorneys failed to appear at trial.

  • As a result of the foreclosure proceedings, the plaintiff incurred over $13,000 in attorney’s fees and claimed emotional distress, including stress-related health issues and embarrassment from unsolicited inquiries about the sale of her home. She subsequently sued under multiple consumer protection laws, including the FDCPA, alleging that the foreclosure action itself and the defendant’s failure to respond to certain information requests violated federal law.
  • The district court dismissed the case at summary judgment, holding that the plaintiff lacked standing because her alleged injuries were not sufficient to sustain an FDCPA claim.

The ruling: On appeal, the Sixth Circuit partially agreed that the plaintiff lacked standing, but took a different approach.

  • The appellate court acknowledged that attorney’s fees and emotional distress could constitute a “concrete, particularized injury” under the FDCPA.
  • However, it ruled that the plaintiff failed to establish a causal connection between those injuries and any specific FDCPA violation by the defendant. The court reasoned that while the plaintiff’s financial and emotional harm was real, it was not directly caused by any illegal debt collection practice — rather, it resulted from the defendant’s lawful pursuit of foreclosure.
  • “In the present case, [the plaintiff] readily admits that she stopped making payments on the Loan. She failed to adduce any evidence at summary judgment demonstrating that [the defendant] violated the FDCPA specifically by bringing or continuing to pursue the Foreclosure Action,” the ruling states.
  • The court noted that a plaintiff cannot claim an FDCPA violation simply because he or she experienced distress from legal actions taken by a creditor when those actions were lawful.
  • Since the plaintiff did not present sufficient evidence that the foreclosure was pursued in a way that violated the FDCPA, the court found that her injuries were not traceable to an actionable claim.
