Judge Dismisses FDCPA Suit Because Claims Weren’t Specific Enough

A District Court judge in Maryland has granted a motion to dismiss claims that a creditor and a collection law firm violated the Fair Debt Collection Practices Act and state consumer protection laws, ruling that the plaintiff’s allegations failed to plausibly demonstrate any unlawful conduct.

The background: The lawsuit stemmed from an unpaid credit card debt. After experiencing a loss of income, she sought to negotiate a repayment plan with the creditor that aligned with her financial situation. However, when her request was denied, the creditor proceeded with collection efforts, seeking to recover a disputed balance of $6,211.88.

  • In her complaint, the plaintiff alleged that had she known how aggressively the creditor would attempt to collect the debt, she would not have signed up for the credit card in the first place.
  • The plaintiff also claimed that the creditor violated the FDCPA by imposing payment terms that did not accommodate her financial hardship and by failing to validate the debt upon request.
  • Additionally, she accused the collection law firm of attempting to collect unauthorized amounts and misrepresenting the legal status of the debt in violation of both federal and state consumer protection laws.

The ruling: In granting the defendants’ motions to dismiss, Judge Deborah L. Boardman of the District Court for the District of Maryland ruled that the plaintiff’s claims lacked the necessary factual support to proceed. Specifically, Judge Boardman found that:

  • The Creditor Is Not a “Debt Collector” Under the FDCPA: The FDCPA applies only to entities whose primary purpose is collecting debts or those who regularly collect debts owed to another entity. The judge determined that the creditor did not fit this definition, making the plaintiff’s FDCPA claim against it legally unsustainable.
  • Failure to State a Plausible Claim Against the Collection Law Firm: The court dismissed the claims against the law firm on the grounds that the plaintiff failed to specify which amounts were unauthorized or unjustified, why they were unlawful, or how the firm’s conduct violated the statutes she cited. The judge noted that simply alleging a violation without providing supporting details does not meet the legal standard for plausibility.
  • Lack of Specificity in State Law Claims: The plaintiff’s allegations under Maryland’s Consumer Protection Act (MCPA) and Consumer Debt Collection Act (MCDCA) were similarly found to be vague and conclusory. The plaintiff did not explain how the creditor misrepresented its debt collection practices or why the collection law firm’s actions were deceptive or unfair under the law.
