State Appeals Court Affirms Ruling in High-Profile FCRA Case

In a case that has made its way across the country and up and down the legal ladder — including a stop at the Supreme Court in a case that is cited daily in today’s collection world — an Illinois state Appeals Court has affirmed the ruling of a lower court in a Fair Credit Reporting Act case.

The background: The origins of this case trace back to a broader legal battle against one of the major credit reporting agencies. The defendant, a credit reporting agency, was accused of violating the FCRA. The issue stemmed from the use of a product called the “OFAC Name Screen Alert.” This product cross-referenced a consumer’s name against the U.S. Treasury’s Office of Foreign Assets Control (OFAC) List. Unfortunately, due to the commonality of names in the U.S., this often led to false matches, where individuals with similar names to those on the OFAC List were flagged inaccurately.

  • The plaintiff, initially part of a broader class action, had his claims dismissed due to a legal standing issue after the U.S. Supreme Court ruled that only certain class members had suffered concrete harm (anyone heard of TransUnion v. Ramirez?). Despite this, he filed a new class action lawsuit in Illinois, asserting that the credit reporting agency failed to properly disclose the existence of such alerts and violated provisions of the FCRA, which mandates that consumer credit reports be accurate and transparent.

The ruling: The Illinois Appeals Court affirmed the decision of the lower court, which had dismissed the case. The defendant argued that the case was time-barred by the FCRA’s statute of limitations. The plaintiff countered by asserting that the equitable tolling doctrine should apply, which would allow the case to proceed despite the expiration of the standard statute of limitations.

  • However, the court rejected this argument, citing Illinois’ rule against “cross-jurisdictional tolling,” which prevents the tolling of a case from one jurisdiction (such as federal court) to another (state court). Furthermore, the court found that the plaintiff had not demonstrated extraordinary circumstances that would justify tolling the statute of limitations.
  • The plaintiff’s attempt to invoke equitable tolling in light of a legal decision that affected his ability to file the case was deemed insufficient, which may be the final chapter in this long-running legal saga.
